1. Agreement to Terms
These Terms and Conditions govern website development, digital marketing, hosting, and support services provided by Got Viral, located in Pune, Maharashtra, India. By requesting a quotation, paying an advance deposit, or commissioning website development work, the client agrees to these terms.
2. Scope of Work & Quotations
All deliverables, page structures, functional integrations, and milestones are documented in a formal written quotation or project specification before work begins. Work outside the written scope requires a separate written estimate.
Our advertised Starter Business Website starting at ₹5,000 covers agreed baseline multi-section pages, mobile responsiveness, lead inquiry forms, WhatsApp integration, basic on-page SEO, 1 year of hosting, and 1 year of support under stated terms. It does not include complex e-commerce, third-party subscription fees, custom database backends, or unlimited revisions.
3. Payment Milestones
Standard payment terms require an advance deposit (typically 50% or as stated in the project quotation) before development begins. The remaining balance is payable upon design approval and before final deployment to the production server and credentials handover. Invoices are issued in Indian Rupees (INR).
4. Client Responsibilities & Content Delivery
The client is responsible for supplying all business texts, high-resolution product images, logo files, certifications, and approvals in a timely manner. The client warrants that all text and media supplied are owned by the client or legally licensed. Got Viral accepts no liability for copyright infringement in client-supplied materials.
5. Project Timelines & Approval Delays
Estimated timelines (e.g., 3 to 7 working days for starter websites) commence only after the advance deposit and all required business content have been received. Project delays resulting from late content submission, unresponsive communications, or scope adjustments will extend the delivery schedule accordingly.
6. Revisions & Scope Adjustments
Each package includes agreed rounds of revisions during the initial preview milestone to refine text alignment, colors, typography, and section arrangements. Revisions do not cover fundamental changes to the confirmed site architecture or requests for entirely new features after development has commenced. Additional revision rounds are quoted separately.
7. Hosting Inclusions & Renewals
Where a package includes "1 Year Free Hosting", hosting is provided on our standard server environment suitable for typical business traffic. The free hosting period runs for 365 calendar days from domain setup. Subsequent annual hosting renewals are charged at prevailing rates confirmed in your initial agreement. Domain name registration is billed separately according to registry fees.
8. Support Inclusions & Exclusions
The included "1 Year Website Support" covers operational bug fixes, server uptime monitoring, and minor text/phone number updates. It specifically excludes major architectural redesigns, bulk e-commerce product entry, new feature builds, or troubleshooting third-party scripts installed without our authorization.
9. Third-Party Software & External Services
Got Viral is not responsible for price changes, terms modifications, or service downtime of third-party platforms, including domain registrars, payment gateways (Razorpay, Paytm, Cashfree), WhatsApp Cloud API, Hostinger server infrastructure, or search engine ranking algorithms.
10. Ownership & Intellectual Property Handover
Upon settlement of all invoices, the client is granted full ownership and administrative control of the deployed website files and bespoke code created specifically for their project, subject to open-source licenses (e.g., PHPMailer MIT license) and third-party asset licenses.
11. Cancellations & Refund Policy
If a client cancels a project after development work has commenced, the advance deposit is non-refundable to cover consumed engineering and design labor. Completed work up to the cancellation date will be provided to the client. Once a website has been approved, deployed to the live domain, and handed over, fees paid are non-refundable.
12. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Got Viral shall not be liable for indirect, incidental, or consequential damages, loss of business revenue, or data loss. Got Viral makes no false promises regarding guaranteed sales figures, specific Google rank positions, or revenue amounts.
13. Governing Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any legal dispute or proceeding arising out of or related to these terms shall be subject to the exclusive jurisdiction of the competent courts in Pune, Maharashtra.
